π¬π§ General Terms and Conditions (GTC)
The Breakers Diving & Surfing Lodge β Somabay
(Effective: July 02, 2025)
1 β Scope of Application
These General Terms and Conditions apply to contracts for the temporary rental of hotel rooms for accommodation purposes and to all related services and deliveries provided by the hotel. Diverging terms and conditions of the guest shall not apply unless expressly agreed in writing.
2 β Conclusion of Contract
2.1. The accommodation contract comes into effect with the written confirmation of the booking by the hotel via email or other written form.
2.2. Reservation requests are non-binding. If the guest does not respond within the deadline set by the hotel (usually 48 hours), the offer may expire, and the room may be reassigned.
2.3. The agreed deposit is a condition precedent for the final effectiveness of the contract. If payment is not made on time, the hotel may withdraw from the contract.
3 β Services, Check-in & Check-out
3.1. The hotel is obliged to provide the reserved rooms and agreed services during the booked period.
3.2. There is no entitlement to specific rooms or specific room location.
3.3. Check-in is from 3:00 p.m., check-out until 12:00 noon (Breakers Time). There is no entitlement to earlier occupancy of the room.
3.4. Early arrivals and late departures are depending on availability and must be requested individually. Additional Fees may apply.
4 β Prices, Payment, Default
4.1. The confirmed prices include all applicable taxes.
4.2. Full payment is due upon arrival at the latest.
4.3. Statutory regulations on payment default apply.
4.4. Accepted payment methods: Cash (EUR, USD, CHF, GBP, EGP) and credit cards (Visa, MasterCard, American Express (Only on site, not with down payment).
4.5. All incidental charges incurred during the stay must be settled by the time of check-out.
4.6. It is not permitted to bring food and beverages for consumption in the public areas or in the rooms of the hotel. Exceptions require the express consent of the hotel.
5 β Kids Policy
5.1. Maximum one child aged 0 to 5.99 years can be accommodated with the parents in a double room (free of charge).
5.2. There is no possibility to provide an extra bed for the child, the overnight stay takes place in the parents bed.
6 β Guest Cancellation / Withdrawal
6.1. Cancellations are free of charge up to 14 days prior to arrival.
6.2. From the 14th day before the start of the service, 150,00β¬ will be retained in the event of cancellation.
6.3. For cancellations from the 7th day before the start of the service or in the event of non-commencement of the trip or use of the service,
200,00β¬ will be charged.
6.4. The date of receipt of the cancellation notice by the hotel is decisive for the deadline.
6.5. The guest may provide evidence that no or less damage has occurred.
Note: For group bookings, events, or special offers, different terms may apply and take precedence over these GTC.
7 β Hotel Withdrawal
7.1. The hotel may withdraw from the contract if:
- a deposit is not paid on time,
- the guest provided false information, or
- the stay endangers the operation or reputation of the hotel.
7.2. Claims for damages by the hotel remain unaffected.
8 β Force Majeure
In the event of force majeure, meaning circumstances beyond the control of both parties that were unforeseeable at the time of contract conclusion and directly affect the hotel’s ability to provide its services at the agreed location (e.g., natural disasters at the hotel site, pandemics with official travel bans to the destination, government-imposed closures of the hotel), both the guest and the hotel are entitled to withdraw from the contract. In such cases, claims for damages or compensation are excluded.
Political unrest or events in other regions or countries that do not directly impair the hotel’s operations do not constitute force majeure under this clause.
9 β Hotel Liability
9.1. The hotel is liable for damages resulting from injury to life, body, or health, insofar as the hotel, its legal representatives, or its agents are responsible for such damages through intent or gross negligence, in accordance with applicable law.
9.2. Guests are advised to store valuables, cash, and important documents in the room safe. The hotel assumes no liability for loss, theft, or damage to valuables, cash, or important documents unless these have been deposited at the reception against receipt for safekeeping in the hotel safe. Further liability is excluded to the extent permitted by law.
9.3. The hotel assumes no liability for vehicles parked on hotel premises.
9.4. The hotel is not liable for third-party services (e.g., diving courses, excursions, transfers, car rentals, spa treatments). The respective providerβs terms and conditions apply.
10 β Data Protection
Personal data is processed in accordance with applicable data protection laws. The privacy policy can be accessed at www.thebreakers-somabay.com/privacy.
11β Final Provisions
11.1. Changes and additions to the contract must be made in writing.
11.2. Place of performance and jurisdiction is Hurghada, Egypt.
11.3. The law of the Arab Republic of Egypt applies.
11.4. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
